Shaun Livingston

Solicitor - September 2013

Shaun joined the social welfare department at TV Edwards in October 2020. He practises a range of Court of Protection and community care work, representing clients who lack capacity in the Court of Protection; advocating for the rights of children in need, care leavers and disabled adults; challenging unlawful policies on public law grounds; and bringing claims against public authorities in respect of human rights violations.

Regularly instructed by the Official Solicitor, Shaun takes referrals from a range of advocates and charities. He began his legal career as a solicitor working in insurance law, before moving on to represent clients with fatal asbestos diseases. A desire to branch into public law and effect positive social change for individuals and wider society led to his volunteering full-time at Liberty, the Anti-Trafficking and Labour Exploitation Unit and the Prisoners Advice Service. Shaun continued to learn his trade as a paralegal in the Public Law and Human Rights department at Irwin Mitchell, where he assisted on a judicial review of Surrey County Council’s decision to cut £21m from its budget for children with special educational needs, before accepting a role as a solicitor at GT Stewart in its community care department.

Shaun takes a particular interest in promoting the best interests of adults who lack capacity to do so themselves and often do not have family members to fight their corner. He acted for the applicant in DL (by her litigation friend the Official Solicitor v London Borough of Enfield [2019] EWCOP B1, helping to secure a judgment from Senior Judge Hilder that restated the vital importance of protected parties being able to access their Article 5 rights in the Court of Protection. Shaun also enjoys acting for care leavers and ensuring they are provided with optimum support to allow for a successful transition to adulthood.
